Acceptable Use Policy

You may not use the Service to create, generate, distribute, or facilitate:

• Unlawful, fraudulent, deceptive, or misleading content, including false advertising or impersonation;
• Spam, bulk unsolicited messaging, or content that violates anti-spam or telemarketing laws (such as CAN-SPAM for email, or the TCPA and related rules for text messages and calls);
• Content that infringes intellectual-property rights or misappropriates others' material;
• Harassing, defamatory, hateful, or threatening content, or content that incites violence;
• Sexually explicit content, or content that exploits or endangers minors;
• Malware, or content designed to compromise security or systems;
• Content that violates the privacy or publicity rights of others;
• Content for industries or purposes prohibited by our AI providers' use policies.

• Reverse-engineering, scraping, or attempting to extract the Service's underlying models or code;
• Reselling or sublicensing the Service without authorization;
• Circumventing usage limits, security controls, or access restrictions;
• Submitting inputs you do not have the right to submit;
• Overloading or interfering with the Service's operation.

You are responsible for reviewing and verifying all AI-generated outputs before use or publication. Outputs may contain inaccuracies; you must ensure anything you publish is truthful, lawful, and non-infringing.

Channel-specific rules are yours to meet. Smarkly generates content; it does not send text messages or operate your email list. Where a channel carries its own consent, identification, opt-out or timing requirements — text messaging in particular — you are responsible for obtaining and recording the necessary consent, honoring opt-outs, and complying with those rules before sending anything generated here.

We may investigate suspected violations and may suspend or terminate access for conduct that violates this AUP, with or without notice depending on severity. We may also remove content or report unlawful activity to authorities where required.
